This notice describes the personal data processing (Privacy Notice) by Patrigest S.p.A., with registered offices in via Bernardo Quaranta 40, 20139, Milan (Patrigest).

 

This privacy notice is not applicable to websites, apps and contents of third parties in general, not even in the event that these are accessible from the website www.patrigest.it. In these cases the provisions on the protection of such third parties’ data shall be applicable, that may differ from the provisions hereof and that we recommend you to refer to before providing any data.

 

  1. Data Controller

     

    For the purposes of this Privacy Notice, the data controller is Patrigest S.p.A. with registered offices in via Bernardo Quaranta 40, 20139, Milan, registered in the Milan Business Company Register with number 04508760156 (the Data Controller).

  2. Collected data.

     

    Patrigest collects personal data through the Website when users send their requests through the forms existing on the Website or send any notification by email. “Personal data” means all the information that may be used to directly or indirectly identify a data subject.

    We may automatically collect certain personal data also when users access, use, or interact with us through, the Website.

    Data provided through the Website

    We collect the data provided by users on a voluntary basis, for example by communicating with us or sending their requests or communications by email or by filling out the online forms on the Website for requests for information.

    The personal data that each user may provide in this manner include user’s name and last name, email address, telephone number and all any other personal data provided.

    Data that we may automatically collect

    On the Website we use cookies and similar technological tools (jointly referred to as Cookies) to collect and retain data relating to the use of, access to or interaction through the Website. We may collect, for example, data regarding the type of device used to access the Website, the operating system, your IP address, your general geographical position indicated by your IP address, the type of browser used, the contents you display and access through the Website, how you possibly interact with the contents available on the Website and the key words entered for the research on the Website.   3. Legal basis and purposes of data processing.

    The purposes for which your personal data will be processed by Patrigest as data controller are the following:

    1. replying to your requests for information, including the requests to download the reports on the Website and those forwarded by sending notices by email to the contacts specified on the Website;
    2. performing the mandate assigned and the relevant law obligations;
    3. sending you, by conventional mail, by phone, sms, emails, instantaneous messaging also through the social networks, any commercial, promotional and advertising notice regarding the services and products provided by Patrigest as well as by the other companies, also indirectly, controlling, controlled, under the common control, affiliated, participated by Patrigest;
    4. sending you, by conventional mail, by phone, sms, emails, instantaneous messaging also through the social networks, any commercial, promotional and advertising notice regarding the services and products provided by companies operating in the following sectors: real estate brokerage, condominium administration, financial brokerage or credit mediation, insurance and insurance brokerage, auctions, real estate executions and insolvency procedures, property management and maintenance, energy, furnishing, education and training, lease, IT, marketing and communications.

     

    Patrigest as controller processes your personal data to perform the activities as per point a) of this paragraph 3 and, therefore, to respond to your express requests. Therefore, the legal basis is the Data Controller’s legitimate interest to respond to the requests of the data subjects. Such interest of the Data Controller was balanced with the interest of the data subjects and is compatible with the latters’ reasonable expectation, as it is reasonable to believe that the latters wish to receive a reply to their requests.

    Patrigest as controller processes your data to perform the activities as per point b) of this paragraph 3 and, therefore, to perform the activities regarding the mandate assigned by the data subject. The legal basis is therefore the implementation of contractual measures.

    The processing of your personal data is required for the purposes as per points a) and b) of this paragraph 3: without it it will not be possible to follow up your requests.

    Patrigest processes your data to perform the activities as per points c) and d) above only with your express consent. Therefore, the legal basis is your consent.

    Your consent must be validly provided and revoked with reference to one or more of the aforementioned data processing purposes.

    The consent provided may be revoked at any time by methods similar to those used in giving your consent, i.e. by contacting us to the addresses specified at the bottom hereof, without affecting the lawfulness of the data processing based on the consent before the occurred revocation.

  4. Disclosure of the personal data collected.

    The Data will be processed by the Data Controller and the processors appointed by the latter and may be disclosed to third parties exclusively whenever this is necessary for the performance of the activities as per the foregoing article 3.

    The Data third party recipients may process it as autonomous controllers or data processors duly designated, as the case may be.

    The full list of Data processors is kept at the Data Controller’s offices and may be consulted upon request to be sent to the addresses specified in the following article 8.

  5. Processing modes

    Data will be processed by the Data Controller’s employees and/or collaborators specifically designated as persons authorised to data processing (i.e., by way of example without limitations, the persons responsible for human resources, legal affairs, administration and IT) or data processors, whose names are made available upon request to be made to the Data Controller pursuant hereto.

    The Data Controller and the third parties on which the same relies process your personal through manual or digital or automated processing tools, for strictly related purposes, retaining it in servers and/or archives within the European Union and in any case in such a way to guarantee Data security and confidentiality.

  6. Data disclosure.

    Your personal data shall not be disclosed.

  7. Data retention period.

    Patrigest as controller shall retain your personal data in any form that allows your identification for a period of time not exceeding the time required for achieving the processing purposes and, in particular, for the purposes specified under point a) of paragraph 3 data will be retained for max. 12 months from collection; for the purposes specified under point b) of paragraph 3, for the entire duration of the mandate in case of the assignment thereof and the relevant time limitation; for the purposes specified under points c) and d) of paragraph 3 for max. 24 months from collection.

  8. Rights of the data subject.

    Each data subject is entitled at any time: (I) to obtain confirmation of the existence or non-existence of their personal data; (II) to know the purposes and terms of data processing, the recipients of such Data, the data retention period; (III) to obtain personal data rectification or erasure and, if applicable, restriction of processing; (IV) to object to processing; (V) if applicable, to receive their personal data provided to the Data Controller in a structured, commonly used, machine-readable format and send it to another data controller without any impediment by the Data Controller; (VI) to file any complaint to the Personal Data Protection Authority; VII) to select the modalities in which the data subject wishes to be contacted for the purposes under points c) and d) of the foregoing paragraph 3, and, in particular, to specify whether he/she wishes to be contacted by the so-called conventional modes (paper mail, telephone with operator), by the so-called automated modes (email, sms, telephone without operator etc.) or both categories.
